Service Waiver & Terms

By requesting a quote or service from Inspiring Landscaping ("the Company"), you ("the Client") agree to the following terms.

1. Estimates

Quotes are estimates based on the information and photos provided and are valid for 30 days. Final pricing may change due to site conditions discovered during work, material cost changes, or changes requested by the Client. A quote request does not create a contract; work begins only after a written agreement or approved estimate.

2. Property access & accuracy

The Client confirms they own the property or are authorized to approve work on it, and grants the Company access to perform the estimate and work. The Client is responsible for disclosing property lines, HOA rules, and known hazards.

3. Underground utilities & hidden conditions

The Client must disclose any private underground lines (sprinklers, low-voltage wiring, pet fences, septic, gas or electric lines). The Company is not responsible for damage to unmarked or undisclosed lines, or for pre-existing conditions such as old piping, poor drainage, roots, rock, or soil issues.

4. Plants, sod & natural results

Plants, trees and sod are living materials. The Company is not responsible for plant loss caused by weather, pests, disease, animals, improper watering, or Client neglect after installation. Results may vary by season.

5. Irrigation & water

The Company is not responsible for water bills, water restrictions, or damage resulting from Client changes to irrigation settings, power outages, or pre-existing plumbing failures.

6. Release of liability

To the fullest extent permitted by California law, the Client releases and holds harmless the Company, its owners, employees and subcontractors from claims for injury, loss or damage arising from the Client's property conditions, the actions of the Client or their guests, or causes outside the Company's reasonable control. This does not limit liability for the Company's gross negligence or willful misconduct.

7. Limitation of liability

The Company's total liability for any claim related to its services is limited to the amount paid by the Client for the specific work at issue.

8. Safety during work

The Client agrees to keep children, pets and guests away from active work areas, equipment and fresh concrete.

9. Payment & cancellation

Payment terms will be stated on the approved estimate. Deposits for custom materials may be non-refundable once ordered. Late or unpaid balances may be subject to collection.

10. Photos

The Client gives permission for the Company to photograph completed work for its portfolio and social media, without showing the address or personal information.

11. Governing law

These terms are governed by the laws of the State of California. Disputes will first be addressed in good faith, then in the courts of Orange County, California.
